Terms of service
Last updated 25 April 2026 · Effective immediately
These terms govern your use of Masterly. By creating an account or using the product you agree to them. If anything is unclear, email [email protected] and we'll explain - in plain English, the same way the rest of this document is written.
01What Masterly does
Masterly is an AI-assisted learning platform. We help parents and guardians manage personalised daily learning sessions for one or more students. The product covers skill tracking, adaptive sessions, AI-graded responses, weekly insights, and a workflow for processing schoolwork uploads.
We do not deliver formal qualifications, accreditations, or guaranteed academic outcomes. Masterly is a complement to schooling, not a substitute for it.
02Who can use Masterly
You must be at least 18 years old to create a parent or guardian account. Student profiles are managed by the account holder, who is responsible for any consents required in your jurisdiction (including COPPA in the US, parental consent under GDPR, and equivalent regimes).
You're responsible for the security of your account credentials and for all activity under your account.
03Acceptable use
You agree not to:
- Misuse the AI. Submit content designed to elicit harmful, illegal, or abusive output, or attempt to circumvent the safety measures that govern AI grading.
- Abuse the infrastructure. Scrape, automate, or otherwise hammer the API beyond the rate limits we publish; attempt to access other users' data; or interfere with security mechanisms.
- Upload harmful content. Materials you don't have rights to, malware, pornographic content, or anything in clear violation of Australian law or the laws of your jurisdiction.
- Resell or repackage. Repackage Masterly as your own product or resell access without a written agreement with us.
We may suspend or terminate accounts that violate these rules. Where possible we'll warn first; serious or repeat violations are immediate.
04AI-generated content and grading
Masterly uses third-party AI models to generate questions, worked examples, scaffolds, weekly insights, and to grade student responses. AI output is probabilistic - it can be wrong, biased, or inappropriate even with our safety measures.
We give you tools to override grades and remove generated content. The parent or guardian remains the final authority on what reaches the student and how performance is judged.
AI-graded responses are subject to monthly limits on the Free plan. Multiple-choice and numeric questions are graded deterministically and don't count toward the cap.
05Subscriptions and billing
Free accounts are free to use within the published limits. Paid plans (Standard, Family) are billed monthly through Stripe. Prices include applicable taxes where shown; otherwise they're added at checkout.
You can cancel from Settings → Billing at any time. Your subscription stays active until the end of the current billing period. After that you drop to the Free plan with the usual limits - your data is preserved.
Refunds are handled in line with Australian Consumer Law and equivalent consumer protection regimes in your jurisdiction. Contact us if you believe you're entitled to a refund.
06Your content
You retain ownership of the content you upload (worksheets, prompts, profile narratives). You grant Masterly a limited licence to process that content solely to provide the product to you - extract questions, grade attempts, generate artifacts, store backups.
We don't use your content to train external AI models. See the Privacy policy for the full data-handling story.
07Service changes
We may add, change, or remove features as Masterly evolves. We'll give you reasonable notice (usually at least 30 days) before removing features that materially affect a paid plan.
We may run maintenance that briefly interrupts the service. Where possible we'll schedule it outside Australian evenings and weekends.
08Termination
You can delete your account at any time from Settings → Danger zone. Deletion is permanent - student profiles, history, and any active subscription all go.
We may terminate or suspend accounts in response to violations of these terms or to protect other users. We won't use termination as an end-run around your consumer rights.
09Disclaimer and liability
Masterly is provided “as is”. To the maximum extent permitted by law, we exclude all implied warranties not expressly required by Australian Consumer Law (or the equivalent in your jurisdiction).
Our total liability to you in any 12-month period is capped at the greater of the fees you've paid us in that period or AU$100. We're not liable for indirect, consequential, or special damages, except where this limitation is prohibited by law.
Nothing in these terms excludes or limits any guarantee, right, or remedy that cannot lawfully be excluded under Australian Consumer Law.
10Disputes and governing law
These terms are governed by the laws of Victoria, Australia. Any dispute that we can't resolve through good-faith conversation will be heard in the courts of Victoria.
We'd much rather sort issues out by email. Reach out before considering anything more formal.
11Changes to these terms
We'll update the “last updated” date above whenever these terms change. Material changes will be emailed to active account holders with at least 30 days' notice. Continued use after the effective date constitutes acceptance.
